Introduction

Switch’s CEO and Founder, Rob Roy, firmly believes in KARMA: if you put good energy out into the world you get good energy back. In line with this core principle, Switch does not transmit, receive, store, process, control, sub-process, manage, manipulate, or otherwise access or utilize data on behalf of its customers or data located on its customer’s equipment, servers, or computers. Switch does collect certain information from its customers and users of its website.

This Privacy Policy (the “Policy”) describes how Switch and its affiliates’ (collectively, “Switch” “we”, “us”, or “our”) collect, use and disclose information through Switch’s website and online services that link to this Policy (collectively, the “Website”), at Switch’s data center facilities in connection with granting, administering, and monitoring physical access to those facilities (collectively, the “Facilities”), and in connection with events where Switch sponsors, hosts, participates, or otherwise collects information (the “Events“). The Website, the Facilities, the Events, and the services provided by Switch, are collectively referred to in this Policy as the “Services.”

This Policy applies to information Switch collects through the Services, including online through the Website and offline at the Facilities; however, it does not apply to information that you ask us to share with third parties or that is collected by certain other third parties whose software or services are featured or included in the Services (as further described below). It also does not apply to information collected from our employees.

This Policy describes, among other things:

• Personal and other information we collect about you;
• How we use your information;
• How we may share your information with third parties; and
• Your choices regarding the personal information we collect about you.

1. Consent

By accessing or using the Services, including the Website or visiting a Facility, you consent to this Policy. If you do not agree with this Policy, please do not access or use the Services.

2. Collection of Your Personal and Other Information

When you access or use our Website, we may collect your Personal Information. We also collect Personal Information when a customer, vendor, or related party visits a Switch Facility, or when we collect or receive attendee information at or in connection with an Event. Switch collects Personal Information and non‑Personal Information through the Services, including through the Website and at the Facilities, as described below. By “Personal Information” we mean information that can identify or reasonably be linked to an individual.

a. Information Collected Through the Website

Switch uses certain cookies and other analytical tools to gather information regarding the users of its website. This information may include your IP address, general location, browser session information, and other related data. Switch uses this information to optimize the user experience, gather website use analytics, and for marketing and advertising purposes. None of these tools give Switch access to any of your Personal Information. More information regarding the cookies that Switch utilizes on the Website can be found in Section 5 below.

When you complete the contact form on our website, you provide us with the following types of Personal Information:

• Name;
• Company;
• Job title;
• Phone number;
• Email address; and
• Any Personal Information inputted into the comment box.

Our Website may link to social media platforms, including Meta Platforms, Inc., X Corp. and LinkedIn Corporation. You should read each social media platform’s privacy policy.

b. Information Collected at Switch Data Center Facilities

When an individual seeks access to a Facility, whether as a visitor or authorized representative of our customers, vendors, or service providers, Switch collects Personal Information necessary to verify identity, issue credentials, and maintain the security of its Facilities, systems, and personnel. In addition to the types of Personal Information we collect when you use our Website, we may collect the following categories of Personal Information when you visit a Facility:

• Driver’s license or government-issued identification card presented for verification;
• Photograph used for badge issuance;
• Badge, keycard, or other credential identifiers;
• Access logs showing dates, times, and points of entry and exit; and
• Certain biometric identifiers or biometric information, specifically fingerprints, collected from authorized individuals at the Facilities for identity verification and access control purposes through BioConnect’s biometric readers (for more details, you can view BioConnect’s privacy policy here: https://bioconnect.com/legal/privacy-policy).

c. Information Collected at and Received from Events

In connection with an Event, we may collect Personal Information directly from attendees, and we may also receive attendees’ Personal Information from the Event organizer. The Personal Information we collect or receive in connection with Events may consist of business contact information, such as name, company, job title, phone number, and email address.

d. Non-Personal Information

We also collect non-Personal Information relating to the Website, that is, information that may not be reasonably linked to an individual (“Non-Personal Information”). The non-Personal Information we collect includes how you interact with the Website, information generally collected or “logged” by Internet websites or Internet services when accessed or used by users, and information about your web browser or device accessing or using the Website. Examples of the non-Personal Information we collect are:

• The pages of our Website that you viewed during a visit;
• What information, content you view or interact with using the Website;
• Language preferences;
• The city and state in which you are located (but not your precise geographic location); and
• Unique identifiers that are not connected and cannot reasonably be connected to your identity.

3. Use of Your Information

We may use the information we collect to:

• Assist us in providing, operating, maintaining, and protecting the Services (including the Website and the Facilities);
• Set up, maintain, and protect accounts to use the Services;
• Grant, manage, and revoke access to our Facilities;
• Authenticate authorized individuals and verify their identities for access into our Facilities;
• Maintain physical and information security;
• Engage with attendees of Events, including to send marketing and promotional communications, provide information about our products and services, and respond to inquiries and requests;
• Improve our online operations;
• Process transactions;
• Provide customer service;
• Communicate with you, such as provide you with account- or transaction-related communications, or other newsletters, RSS feeds, and/or other communications relating to the Services;
• Send or display offers and other content to you;
• Prevent fraud and other misuse;
• Perform research and analysis aimed at improving our products and services and developing new products or services;
• Manage and maintain the systems that provide the Services, including website infrastructure and physical access control systems; and
• Comply with our legal obligations and exercise our legal rights.

4. Disclosure of Your Information

We may disclose Personal Information collected through the Services, including information collected through the Website, at the Facilities, and collected at or received in connection with Events, as described below.

We may disclose Personal Information to provide the Services, or when you authorize or instruct us to do so, for example, when you use the Services to submit content or profile information.

• Service Providers. We may also disclose Personal Information and non-Personal Information to Service Providers. By “Service Providers” we mean companies, agents, contractors, service providers, or others engaged to perform functions on our behalf. These services may include, for example, payment processing; data storage; website hosting; physical security, access control, or monitoring; marketing our products and services; and conducting audits. When we use a Service Provider, we require that the Service Provider use and disclose the Personal Information received from us only to provide their services to us or as required by applicable law.
• Online Tool Providers and Tracking Technologies. We may also disclose Personal Information and non-Personal Information to Online Tool Providers. By “Online Tool Provider” we mean a licensor of software that we include in, or use with, the Services, including an application program interface (“API”) or software development kit (“SDK”), that provides a specialized function or service to us and that requires the transmission of Personal Information and/or non-Personal Information to the Online Tool Provider. Online Tool Providers, Cookies, web beacons, pixels, tags, and similar third-party technologies are collectively referred to herein as “Tracking Technologies.” Tracking Technologies may have the right to use Personal Information and non-Personal Information about you for their own business purposes. The use and disclosure of Personal Information and non-Personal Information by third-party Tracking Technologies are described in their respective privacy policies. See Section 5 below for some of the key Tracking Technologies we use.
• Affiliates. We may share information to our subsidiaries, affiliated companies or other trusted businesses or persons for the purpose of processing personal information on our behalf. We require that these parties agree to process such information based on our instructions and in compliance with this Policy and any other appropriate confidentiality and security measures.
• Compliance. We may also disclose your Personal Information to third parties when we believe, in good faith and in our sole discretion, that such disclosure is reasonably necessary to (a) enforce or apply the terms and conditions of the Services, including investigation of potential violations thereof, (b) comply with legal or regulatory requirements or an enforceable governmental request, (c) protect the rights, property or safety of us, our users or other third parties, (d) submit insurance claims, cooperate with insurance investigations, and fulfil insurance subrogation activities, (e) prevent a crime or protect national security, or (f) detect, prevent or otherwise address fraud, security or technical issues.
• Business Transfers. Finally, we reserve the right to transfer information (including your Personal Information) to a third party in the event of a sale, merger, or transfer of all or substantially all of the assets of our company relating to the Services, or in the unlikely event of a bankruptcy, liquidation, or receivership of our business. We will use commercially reasonable efforts to notify you of such transfer, for example, via email or by posting notice on our Website.

5. Cookies and Automatic Information Gathering Technologies

Every time you use the Website (e.g., access a webpage), we collect Personal Information and non-Personal Information (discussed above in Section 2) regarding that use. For example, to improve our Website, we collect how, when, and which parts of the Website or its features you use. Also, we may use your device’s unique identifier or other unique identifiers to assist us in collecting and analyzing this data.

To assist us in collecting and storing this Information, we may employ a variety of technologies, including “Cookies,” local browser storage, and web beacons, pixels, or tags. A Cookie is a small amount of data a website operator, or a third party whose content is embedded in that website, may store in your web browser and that the website operator or, as applicable, the third party, can access when you visit the website. A web beacon, pixel or tag is a small, usually-transparent image placed on a web page that allows the operator of that image, which may be the operator of the website you visit or a third party, to read or write a Cookie. Your operating system and web browser may allow you to erase information stored in Cookies and local browser storage. You may also be able to set your browser to refuse all website storage or to indicate when it is permitted. Tracking Technologies may collect information automatically, in which case Personal Information and non-Personal Information it receives are subject to the Tracking Technology’s privacy policy. Some Tracking Technologies may allow you to opt out of certain collection and/or uses of your information. We may replace any of these Tracking Technologies without notice to you. For more information about the privacy practices of the Tracking Technologies that Switch currently uses (and/or that we reserve the right to use), please see below:

6. Transparency and Choice; Do Not Track Signals

You may request access to your Personal Information by sending an email to [email protected]. We will try to locate and provide you with your Personal Information and give you the opportunity to correct this data, if it is inaccurate, or to delete it, at your request. But, in either case, we may need to retain it for legal reasons or for legitimate business purposes, and such choice is in Switch’s sole discretion. Please be aware that if you request us to delete your Personal Information, you will be required to provide us with certain Personal Information before being able to access the Facilities. If you request deletion of your Personal Information and decline to provide the Personal Information required for identity verification and credentialing, Switch will be unable to grant or maintain physical access to its Facilities.

We ask individual users to identify themselves and the information requested to be accessed, corrected, or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, would be extremely impractical (for instance, requests concerning information residing on backups), or relate to information that is not associated with your Personal Information. In any case, where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. We may also require you to verify your identity to our satisfaction before providing you with access to Personal Information.

We honor the Global Privacy Control (“GPC”), which is a browser extension that automatically indicates a consumer’s opt-out preferences. We also support the development and implementation of other standardized “do not track,” universal opt-out mechanism, or similar browser features that provide customers with control over the collection and use of information about their web-browsing activities. Once other standardized “do not track” features are widely recognized, we intend to adhere to those features accordingly.

You can opt out of receiving marketing e-mails from us by clicking on the “unsubscribe” link in the e-mails. We use our marketing Service Provider, Outreach Corporation, to send and manage our marketing communications, and your opt out request will be processed through those systems. Please note that it may take up to ten (10) business days for your opt-out request to be processed. Also, even if you opt out of marketing e-mails, we may continue to send you certain account-related e-mails, such as notices about your account and confirmations of transactions you have requested.

7. Information Security and Retention of Personal Information

Switch uses physical, technical, and organizational safeguards designed to safeguard your Personal Information against unauthorized access, modification, or destruction, and protect the security of its systems and the data it collects. Specifically, data collected by the Cookies and other tracking information is stored in a secured cloud location. Other information, such as your log in credentials, are stored in an encrypted database. While Switch practices security protocols to protect your data, please be aware that no data transmission over the Internet and no method of data storage can be guaranteed to be 100% secure. Therefore, while we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its security.

We restrict access to Personal Information in our possession to our employees, Service Providers, and Online Tool Providers who need to know that information in order to operate, develop, improve or support our Services.

Unless stated otherwise in this Policy, Switch will retain information it receives from you where it has a business reason to do so, such as maintaining accurate accounting, resolving disputes, or complying with its legal obligations.

8. Certain State Residents

Switch does not, and does not intend to, sell any information it obtains from you.

Depending on the applicable data protection and privacy laws in your jurisdiction, you may be entitled to legal rights regarding your personal data. Our Services are not currently subject to the privacy laws in Virginia, Colorado, Connecticut, Utah, Oregon, Montana, Nebraska, Delaware, Iowa, New Hampshire, and New Jersey. However, we do provide notice and transparency about our collection and use of Personal Information as described in this Policy.

a. Residents of California

If you reside in the State of California, please click here to learn more about your privacy rights. To the extent that there is a conflict between this Policy and the Privacy Notice for California Residents, the Privacy Notice for California Residents will prevail only if you reside in the State of California (you are a “California Consumer”).

b. Residents of Texas

If you reside in the States of Texas, please click here to learn more about your privacy rights. To the extent that there is a conflict between this Policy and the Privacy Notice for Texas Residents, the Privacy Notice for residents of Texas will prevail only if you are a resident of Texas. Texas law regulates the capture and use of biometric identifiers, including fingerprints. Switch’s collection and use of biometric identifiers at its Facilities is described in Section 6 of the Privacy Notice for Texas Residents and is conducted in accordance with CUBI.

c. Residents of Nevada

9. International Residents

a. Residents of Canada

If you have an objection to the use of your Personal Information as described in this Policy, you may file a complaint by sending an email to [email protected]. We will attempt to accommodate your objection or complaint, but you understand that, to the extent you object to our processing of Personal Information that is necessary for us to provide the Services to you, certain features and functionalities of the Services may no longer be available to you. Nothing in this Policy prejudices your rights to file a complaint with the Office of the Privacy Commissioner of Canada, and/or with any other applicable data protection authorities.

b. European Residents

If you reside in a country in the European Economic Area or in Switzerland, please click here to learn more about your privacy rights. To the extent that there is a conflict between this Privacy Policy and the Privacy Notice for European Residents, the Privacy Notice for European Residents will prevail only if you reside in the European Economic Area or in Switzerland (you are a “European Resident”).

10. Children

The Services are not intended for users under 18 years of age. We do not knowingly collect Personal Information from users under 18 years of age. We do not authorize users under 18 years of age to use the Services.

11. Third Party Websites

Please note that the Website may link or integrate with third-party sites, services or apps. We are not responsible for the privacy or security policies or practices or the content of such third parties. Accordingly, we encourage you to review the privacy and security policies and terms of service of those third parties so that you understand how they collect, use, share and protect your information.

12. Changes to this Policy

Switch reserves the right to revise, modify, or otherwise change this Policy without prior notice. You can always check the “Last Updated” date at the top of this document to see when the Policy was last changed. Please review this Policy periodically to ensure you are aware of Switch’s current privacy practices.

IF YOU DO NOT AGREE TO CHANGES TO THIS POLICY, YOU MUST STOP USING THE SERVICES AFTER THE EFFECTIVE DATE OF SUCH CHANGES (WHICH IS THE “LAST UPDATED” DATE OF THIS POLICY). YOUR USE OF SWITCH’S WEBSITE AND ITS SERVICES INDICATE YOUR CONSENT TO THIS POLICY.
